Welcome to Moivida.com, an online B2B marketplace operated by Moivida India (“Moivida”, “we”, “our”, “us”).
By accessing or using our platform, you (“User”, “Buyer”, or “Supplier”) agree to abide by the following Terms and Conditions (“Terms”).

Please read these Terms carefully before using the website. If you do not agree, please do not access or use the platform.

1. Introduction

Moivida.com is a digital B2B platform that connects buyers, suppliers, and distributors in the medical and healthcare industry.
Our goal is to enable transparent and efficient business connections through product listings, inquiries, and communication tools.

Moivida:

• Does not own or sell the listed products (except where explicitly mentioned).

• Does not verify or guarantee the accuracy, completeness, or authenticity of any listing or user information.

• Acts as a neutral intermediary between buyers and suppliers.

2. Account Registration

• Users must register with valid business details (name, company, email, GST, etc.).

• Users are responsible for maintaining the security and confidentiality of their accounts.

• Any activity under a user’s account is their sole responsibility.

• Moivida reserves the right to suspend or terminate accounts that violate our policies or misuse the platform.

Section A: Terms for Suppliers

1. Supplier Listings

Suppliers on Moivida.com may opt for either of the following listing types:

a. Free Listing

• Free listings allow suppliers to display limited product information and receive inquiries.

• Visibility may be restricted compared to paid listings.

• Moivida does not guarantee traffic, leads, or conversions from free listings.

b. Paid Listing / Premium Plans

• Paid listings or promotional services offer enhanced visibility, product placement, and lead support.

• Payment once made is non-refundable, except in cases of proven technical errors on Moivida’s side.

• Moivida reserves the right to modify or discontinue paid features at any time.

2. Supplier Responsibilities

Suppliers must:

• Provide accurate and updated product and company information.

• Ensure all listings comply with Indian laws, medical device regulations, and trade standards.

• Avoid uploading misleading, counterfeit, or illegal products.

• Respond to buyer inquiries promptly and professionally.

3. Misuse or Misrepresentation

If Moivida detects misuse (e.g., fake listings, spam, impersonation, or fraud), it reserves the right to:

• Suspend or delete the supplier account without refund.

• Remove any misleading content immediately.

• Report the matter to relevant authorities if required by law.

Section B: Terms for Buyers

1. Buyer Responsibilities

   • Verify all supplier credentials before making purchases or payments.

   • Review product specifications, pricing, and warranties directly with the supplier.

   • Use Moivida only for legitimate business purposes.

2. Transactions

   • Moivida is not involved in payment collection or product delivery unless explicitly stated.

   • All transactions take place directly between the buyer and supplier.

   • Moivida shall not be held liable for disputes, product defects, delivery delays, or financial losses.

3. Product Information

   • Listings, images, specifications, and prices are provided by suppliers.

   • Moivida does not verify their accuracy and is not responsible for any misinformation or errors.

Section C: General Platform Terms

1. Disclaimer of Responsibility

Moivida strives to maintain accurate and updated content, but:

• We do not guarantee the accuracy, reliability, completeness, or legality of any data displayed on the platform.

• Moivida is not responsible for any:

  • Errors or omissions in listings or user data.

  • Misuse, misrepresentation, or false information shared by users.

  • Business losses, damages, or disputes arising from third-party actions.

  • Technical issues, downtime, or unauthorized data access.

Users agree to use Moivida at their own discretion and risk.

2. Data Usage and Privacy

• User data is handled as per our Privacy Policy.

• Moivida may collect and use user information for communication, verification, and platform improvement.

3. Prohibited Activities

Users must not:

• Post false or misleading product information.

• Upload illegal or counterfeit goods.

• Use automated tools to scrape or misuse platform data.

• Impersonate other users or entities.

Violation may lead to permanent account termination and legal action.

4. Intellectual Property

• All platform content (logo, design, layout, and database) is owned by Moivida Technologies Pvt. Ltd.

• Users may not reproduce or distribute any material without written permission.

5. Limitation of Liability

To the fullest extent permitted by law, Moivida shall not be liable for any:

• Direct, indirect, or consequential loss, including business interruption or loss of profits.

• Disputes between buyers and suppliers.

• Errors, inaccuracies, or unauthorized data modification on the platform.

6. Governing Law

These Terms are governed by the laws of India.
Any dispute shall fall under the jurisdiction of the courts of Mumbai, Maharashtra.

7. Amendments

Moivida reserves the right to modify these Terms at any time without prior notice.
Your continued use of the platform signifies acceptance of the latest Terms.
